Policies

Policies are a guideline and rulebook for employers to establish formal expectations and standards for employees. Polices are also used to ensure legal and regulatory compliance whether it's within the company or in external interactions with other companies and clients.

Policies are to a company what rules are to the players of a game. They provide a framework and constraints within which everyone can strive for individual and collective success.

A procedure is a document that instructs workers on executing one or more activities of a business process. It describes the sequence of steps, and specifies for each step what needs to be done, often including when the procedure should be executed and by whom.

In short, a procedure is a list of steps (Like a training Manual) demonstrating how to implement a policy.

POPIA - Protection of Personal Information Act

POPI is shorthand for the Protection of Personal Information Act No. 4 of 2013. Signed into law on November 19, 2013, parts of the law became effective on April 11, 2014. The rest of the law became effective on June 22, 2020.

The POPI Act is South Africa’s equivalent of the EU GDPR. It sets some conditions for responsible parties (called controllers in other jurisdictions) to lawfully process the personal information of data subjects (both natural and juristic persons). The POPI Act does not stop you from processing but does require you to get consent from data subjects to process their personal information. Whoever decides why and how to process personal information is responsible for complying with the conditions. There are eight general conditions. The responsible party is also responsible for a failure by their operators (those who process for them) to meet the conditions.

The POPI Act is important because it protects data subjects from harm, like theft and discrimination. The risks of non-compliance include reputational damage, fines and imprisonment, and paying out damages claims to data subjects.

The Promotion of Access to Information Act (“PAIA”), No 2 of 2000 gives effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights. PAIA gives the requester a right to lodge a request from the information officer of a public or private body.

From 1 January 2022 all public and private bodies must have a Promotion of Access to Information Manual (PAIA Manual) in terms of the Promotion of Access to Information Act 2 of 2000 (PAIA). This ends the exemptions to certain bodies that were provided on an ongoing basis.

Health and Safety

The Occupational Health and Safety Act, 1993, requires the employer to bring about and maintain, as far as reasonably practicable, a work environment that is safe and without risk to the health of the workers.
